By agreeing to the terms and conditions herein you have agreed to allow DDTCM LLC to access your computer for purposes of remote desktop support. BY USING THIS SERVICE, YOU ARE AGREEING TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS, HEREAFTER THE "AGREEMENT."
1. Limited Warranty. The software and services of DDTCM LLC are provided on an as-is basis and without warranty of any kind and DDTCM LLC expressly disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose with regard to both software and/or services rendered by DDTCM LLC.
2. Limitation of Liability. Under no circumstances shall DDTCM LLC be liable for any incidental, special or consequential damages that result from the use of, or the inability to use, your computer networks, individual computers, or their peripheral attachments as a result of services provided by DDTCM LLC, whether based on breach of contract, tort (including negligence), product liability or otherwise, or for any defects, including viruses on your computer hardware or in software programs. In no event shall DDTCM's total liability to you for all damages, losses, and causes of action (whether in contract, tort, including negligence), or otherwise, exceed the amount paid by you for services rendered by DDTCM LLC.
3. Controlling Law and Severability. This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Michigan, and shall be subject to binding arbitration pursuant to the guidelines of the American Arbitration Association. If for any reason a court of competent jurisdiction finds any provision of this Agreement or portion thereof, to be unenforceable, that provision of the Agreement shall be enforced to the maximum extent permissible so as to effectuate the intent of the parties and the remainder of this Agreement shall continue in full force and effect.
4. Complete Agreement. The terms and conditions contained in this Agreement contain the entire agreement between the parties with respect to DDTCM's remote assistance service and this Agreement supersedes all prior or contemporaneous understandings or agreements, written or oral, regarding such matter. No amendment of this Agreement may be made unless in writing and signed by a duly authorized representative of DDTCM LLC.
